EB-5 Green Card for Immigrant Investors
Overview
Under the Green Card by Investment program, investors are eligible to apply for EB-5 Green Card (permanent residence) and get their green card in 2-3 years including their spouses and unmarried children under 21. To process with immigration visa in the USA the investor must:
- Create or preserve 10 full-time jobs for qualified US workers and
- Invest in New Commercial Enterprise (NCE) in the US
Green cards by investment category are issued in a limited number which is 10,000 a year. Out of which 3,000 are reserved for investors investing in TEA zones (high employment area). EB-5 Green Card eligibility criteria

Rights of Permanent Residents (Green Card Holders):
- Freedom to work and live anywhere in the United States
- Access a world-class education system with additional benefits for themselves and their children.
- Access to medical care.
- Ability to travel outside of the United States.
- Option to obtain US Citizenship.
- Permanent residents are fully protected by all federal, state, and local U.S. laws.
Responsibilities of Permanent Residents:
- Responsible for local, state, and federal taxes.
- Fulfill the requirement of being physically present in the United States.
- Male Permanent Residents between the ages of 18 and 25 must register with Selective Service.
Where & How to Apply?
In order to file the petition for EB-5 Green Card, you should start with the CIS Form I-526. There are certain requirements and criteria to file for the Green Card by investment category:
- You must establish a New Commercial Enterprise for your EB-5 project.
- Investing the required capital
- Providing a clean trail for the lawful source of funds
- Creating at least 10 full-time jobs within the TEA zone
- Demonstrating your active participation in the business
